People are not allowed to work as independent workers with the Form 1099 while they hold an H-1B visa. The employee - employer relationship under the H-1B visa are same as the standards for STEM OPT extension for the F-1 Visa. The employee is obliged to stay as they are being sponsored by their employer. The H-1B visa holders are not permitted to accept contracts out of the H-1B visa sponsor work. This means that the income earned through the H-1B visa falls under the employment-based income category.

Form 1099 is a tax document filed by the taxpayers for the income earned from the non-employer. This income can be anything from bank interest, dividends, compensation, investment, etc. People who earn a minimum of 600 USD via the following ways need to pay the tax with Form -1099:
