Spain Digital Nomad Visa

Introduced under Spain's Startup Act (Ley 28/2022, effective January 2023), the Digital Nomad Visa was further defined and expanded under Royal Decree 1155/2024, which came into effect in May 2025. The visa allows non-EU remote workers and freelancers to live legally in Spain while working for companies or clients based outside Spain. This act was designed to meet the increasing demand for foreign investment.

The 80/20 Rule: Can I Work for Spanish Clients on the Spain Digital Nomad Visa?

Yes — but with an important limit. Spain Digital Nomad Visa holders may work for Spanish companies or clients, but Spanish-sourced income must not exceed 20% of your total professional income.

What this means in practice: If your total annual income is €60,000, a maximum of €12,000 (20%) can come from Spanish clients or employers. The remaining 80% must come from non-Spanish sources — your foreign employer or international clients.

Why this matters: Exceeding the 20% threshold risks revocation of your DNV status. It can result in loss of Beckham Law eligibility. You may be reclassified as a standard Spanish worker subject to full progressive Spanish income tax, which rises to 47% at higher income levels.

This rule is a compliance requirement, not a suggestion. Indian remote workers who pick up Spanish freelance clients while living in Spain should track their income split carefully throughout the year.

Documents Required for Spain Digital Nomad

  • Proof of Remote Worker Status - You must prove that you are a remote worker that can complete your job from Spain via an internet connection. While there are no specific restrictions when it comes to the type of work that you are engaged in, you must prove that you have specific expertise in your field. This can be demonstrated with a university degree, professional certificate, or proof of three years of work experience.
  • Proof of Financial Self-Sufficiency - You must be able to demonstrate that your work provides you with sufficient income to support yourself while living in Spain. The minimum rate has currently been set at 200% of Spain's 2026 Minimum Interprofessional Wage (SMI) of €1,266/month, as updated under Royal Decree 126/2026, effective January 1, 2026.

An individual applying for the Spain DNV visa must show earnings of at least:

€2,849 per month or approximately €34,188 per year

Family of 2 — €3,798 per month

Family of 3 — approximately €4,115 per month

Family of 4 — approximately €4,432 per month 

  • Full Health Insurance - Applicants must obtain full health insurance for themselves and any family members that accompany them for the full duration of their proposed stay in Spain.
  • Clean Criminal Record – Provide PCC from the countries where they have lived in the last 5 years
  • Minimum Stay - To be eligible for the Spanish Digital Nomad Visa you should not have lived in Spain for the last five years. You also cannot apply from Spain if you are currently there illegally.

  • Valid passport with one-year validity and two blank pages

How to apply for a Spain Digital Nomad Visa?

There are two Ways to Apply for the Spain Digital Nomad Visa.

Route 1: Apply from India at the Spanish Consulate

Best for: Applicants currently in India who have not yet travelled to Spain.

Step 1: Check your eligibility and confirm you meet the €2,849/month income threshold. Step 2: Gather all required documents. Get educational and professional documents apostilled through India's Ministry of External Affairs (MEA).

Step 2: Book an appointment at the nearest Spanish Consulate — New Delhi, Mumbai, or Chennai — through VFS Global India.

Step 3: Submit your application and supporting documents at the consulate.

Step 4: Wait 20–30 working days for a decision.

Step 5: On approval, you receive a 1-year national visa (Type D). Travel to Spain.

Step 6: On arrival in Spain, register at your local Ayuntamiento (municipal office) and apply for your TIE (Tarjeta de Identidad de Extranjero — residence card) within 1 month. TIE processing takes 1–4 weeks.

Route 2: Apply in Spain via UGE-CE

Best for: Applicants already in Spain on a valid visa (tourist, student, or other legal visa).

Step 1: Confirm you are in Spain on a valid, legal visa.

Step 2: Gather all required documents (same checklist as Route 1).

Step 3: Submit your application online through the UGE-CE (Unidad de Grandes Empresas y Colectivos Estratégicos) portal.

MEA Apostille Process

All educational and professional documents must be apostilled through India's Ministry of External Affairs (MEA) before submission to the Spanish consulate. Documents requiring apostille include: University degree certificates Professional certificates and diplomas Employment verification letters Any document that may be more than 6 months old

The MEA apostille process takes 3–10 working days and can be completed at MEA offices in New Delhi, Mumbai, Chennai, Kolkata, Hyderabad, Bengaluru, and other cities, or through authorised MEA agents.

Proving Income as an INR-Paid Professional

If your salary is paid in Indian Rupees, convert your income to EUR using the RBI (Reserve Bank of India) reference exchange rate applicable on the date of your bank statements. Your employer should provide a salary certificate stating your equivalent EUR monthly income. Six months of bank statements showing consistent salary credits are typically required.

India-Spain Double Taxation Avoidance Agreement (DTAA)

India and Spain have a Double Taxation Avoidance Agreement (DTAA) in force. Under the DTAA, Indian remote workers who are already paying income tax in India on their foreign-sourced income are protected from being taxed twice on the same income in Spain. Combined with the Beckham Law's foreign income exemption, most Indian DNV holders pay Indian income tax on their salary and Spanish tax only on any Spanish-sourced income within the 20% limit.

Police Clearance Certificate

The Spanish consulate accepts the Indian police clearance certificate issued by the Passport Seva Kendra or Regional Passport Office. It must cover the last 5 years and must be apostilled through MEA India.

Processing Time for Spain Digital Nomad Visa

There are two application routes, each with different processing times and initial validity periods.
