New six TR to PR pathways in Canada: Procedure to apply

The Canadian government has released a guide describing how international students and essential workers can apply for an open work permit.

 

A set of new official instructions were published online for IRCC (Immigration, Refugees, and Citizenship Canada) for people who applied for TR to PR pathway (temporary residence to permanent residence).

 

In May 2021, it launched six new TR to PR programs, offering immigration pathways for

  • Foreign student graduates
  • Essential workers
  • French speakers in Canada

Individuals who are left with a short amount of validity on their current documents are eligible to apply for these programs. These programs allow applicants to stay in Canada, but IRCC will decide the approval of these applications. These work permits will be valid till December 31, 2022.

 

New Work Permits

The new work permits will be applied to all the six TR to PR pathways. Out of which, three are for English speakers and the other three for French speakers.

 

List of programs for English speakers

  • Workers in Canada – Stream A for health care workers (open for 20,000 applicants)
  • Workers in Canada – Stream B for essential non-health care workers (30,000 applicants – Full)
  • International graduates (40,000 applicants – Full)

List of programs for French speakers

  • Workers in Canada – Stream A for French-speaking health care workers (no cap)
  • Workers in Canada – Stream B for French-speaking essential non-health care workers (no cap)
  • French-speaking international graduates (no cap)

Deadline for application submission

The application date will be closed on November 5, 2021, or waits till IRCC receives the maximum number of applications for each program.

 

So far, the non-healthcare programs for essential workers and international graduates program have filled up.

 

When can I apply for TR to PR pathway?

As per IRCC instructions, you can apply four months before your TR (Temporary Residence) status expires.

 

Procedure to apply

You can apply to any of these pathways through online or through paper applications, as per IRCC guidelines.

Step 1: Arrange all the necessary documents.

Step 2: Pay the necessary fees for your application as per the details given on the government website.

Step 3: Log in to your IRCC account to submit your application form and check your application status.

Step 4: In this step, you need to answer few questions in order to get the personalized document checklist.

Make a note that both students and workers must select the "worker" when they ask for your current immigration status in Canada. This is a temporary note for students, while IRCC will update this option soon to avoid confusion in the application system.
 

Which option applies to you: Then choose “I am applying for an open work permit under an active public policy or pilot program announced by IRCC.”
 

Then you will be asked for “There are fees associated with this application. Will you be paying your fees are or your fee exempt?” Answer “No, I am exempt from paying fees for the application.” Even though you have already paid your $155 fee, you are exempt from paying the open work permit holder fee.

 

Step 5: In this step, you need to start filling the forms as per IRCC’s instructions guide. Make sure that you have the checklist ready with you. IMM 5710 form (Application to Change Conditions or Extend my Stay or Remain in Canada as a Worker).

 

In the end, you will be asked for a duration date no later than December 21, 2022. Remember that you should not ask for a date more than your passport expiry date.

 

Step 6: Upload all the list of correct documents, that includes:

  • A copy of your fees receipt
  • Proof of working legally in Canada (like a work permit)
  • Proof of language test result
  • Copy of passport
  • Digital photo
  • Family Information Form
  • For accompanying family members (medical exam report, marriage certificate, or birth certificates)

But the family members in Canada will have their own document checklist. An 'IMM 0008 (Generic Application form)', this form should have the family member’s name as mentioned in the principal applicant’s application. This can be uploaded in the 'Client Information' section.

 

Next, after application

After applying, your application will be reviewed for the following by an immigration officer.  These officers will verify for the following checkpoints:

  • Employer’s compliance history
  • Eligibility for the work permit
  • Few details if they need more information

If your application is incomplete, they will return your application without processing it.

 

If a person meets all the requirements and is eligible, immigration officers will mail the work permit to your Canadian address, mentioning all the details about

  • Type of work you can do
  • Employer you can work for
  • Where you can work
  • How long you can work
