A permanent resident (PR) or citizen in Canada who is married or has a relationship with an overseas national could sponsor that individual to arrive in Canada to gain permanent residency. The Canadian PR holder or citizen has the eligibility to apply for sponsorship of a spouse/partner via inland or outland sponsorship.
You can opt for Inland sponsorship when your spouse/partner stays with you in Canada.
To gain eligibility for Inland sponsorship, the sponsoring person and the individual being sponsored must fulfill the following requirements:
The relationship between the sponsor and the sponsored individual must be one of the following:
Spouse: You need to have lawfully married, and your wedding must be valid under the jurisdiction’s law where its registration took place and under the law of Canada
Common-law: You are currently living or have lived with your partner in a relationship that is equivalent to marriage for a minimum of 12 consecutive months.
If you have a conjugal relationship, you are not eligible for Inland sponsorship. You can only consider Outland sponsorship.
Applications for Inland sponsorship can be submitted for spouses/partners who have Canadian legal temporary status either as a visitor, worker, or student. The person being sponsored can live, work, or study in Canada while the application for sponsorship is undergoing processing.
The sponsored person is also eligible for an open work permit, which lets them work in Canada full-time while an application for their sponsorship is being processed.
For Inland sponsorship, the sponsored person must reside in Canada while the application processing is ongoing. In case the sponsored person intends to leave Canada or needs to travel outside the country during the processing, they should consider applying for Outland sponsorship.
Individuals can opt for Outland sponsorship when their spouse/partner is not currently staying with you in Canada and is an overseas national living abroad. Since your spouse/partner cannot apply for sponsorship within Canada or is not staying in Canada when the application is being submitted, you are eligible only for Outland sponsorship.
For Outland sponsorship’s eligibility, the person sponsoring and sponsored individual must fulfill the following requirements:

With an Outland sponsorship, the sponsored person can arrive and leave Canada as the application is being processed. Therefore, it may be the choicest option if the work or personal circumstances of the sponsored person require them to travel out of Canada.
