Abstract: The USCIS has declared that it would be adding more 65,000 slots for the H-2B visa.

The DHS or Department of Homeland Security and the DOL or Department of Labor will be adding 64,716 more H-2B visas available for the fiscal year of 2023.

The additional H-2B visas are for employers based in the US seeking additional employees prior to September 15, 2023, according to the USCIS or US Citizenship and Immigration Services. More visas are being added to address the requirement needs of the peak season of employment.

Changed rules for H-2B Visa

The additional H-2B visa slots have approximately 44,700 visas for returning employees who received the H-2B visa or were granted an H-2B visa during the last 3 fiscal years.

The 20,000 visas remaining are for citizens of:

  • El Salvador
  • Guatemala
  • Honduras
  • Haiti

The semi-annual cap of 33,000 visas for the 1st half of FY 2023 was attained on September 12, 2022. The cap is authorized by the Immigration and Nationality Act. The details of the visas available for FY 2023 are given in the table below.

The visas are aimed at returning employees irrespective of their country of origin. This is the first time that the Departments have increased the number of H-2B visas for multiple allocations in a fiscal year, including allocations for the late 2nd half.

The amendments to the H-2B visa protect professionals both national and international employees from injustice.
