Quebec releases 2023 occupation list of easier LMIAs

The Quebec Ministry of Immigration released its Occupation List of 2023 for simplified Labour Market Impact Assessment (LMIA) processing.

The Government of Quebec said that the occupation list affects salaried workers, not self-employed people. Also, it applies to the entire province while considering the labor needs for all regions.

How Quebec’s LMIA differs from the rest of Canada

The applications made through LMIA by employers in Quebec, must be approved by the provincial as well as the federal government.

LMIA changes with NOC 2021

The last update made to the occupation list of Quebec was in 2022. The IRCC has transformed to an updated NOC 2021 version from the National Occupation Classification 2016 (NOC 2016) system.

The Government of Quebec has also informed that the LMIA applications received on or after November 16, 2022, will be processed as per the NOC 2021.

Occupations that usually require a university degree

Financial Advisors; Software Engineers

TEER 2

Occupations that usually require a university degree, a college diploma, apprenticeship training of 2 or more years, or supervisory occupations

Computer Network and Web Technicians; Medical Laboratory Technologists

TEER 3

Occupations that usually require a college diploma, apprenticeship training of less than 2 years, or more than 6 months of on-the-job training  

Bakers; Dental Assistants and Dental Laboratory Assistants

TEER 4

Occupations that usually require a high school diploma, or several weeks of on-the-job training

Home Child Care Providers; Retail Salespersons and Visual Merchandisers

TEER 5

Occupations that usually need short-term work demonstration and no formal education

Landscaping and grounds maintenance labourers; Delivery service drivers and door-to-door distributors

Eligibility conditions for simplified LMIA processing in Quebec

  1. Offering competitive working conditions: Quebec employers must provide a healthy working environment and salary equal to what is offered to a permanent resident or Canadian citizen for a similar job in the same sector.
  2. Abide by the laws and regulations: Employers seeking an LMIA must prove the following:
  • The business must exist in Quebec.
  • Meet all the conditions in the job offer.
  • The business is free of convictions for offenses listed in section 99
  • Offering a job meeting legitimate labor needs
  • The job doesn’t negatively impact Quebec’s labor market.
  1. Provision of Health Insurance to the workers.

Additional criteria for Quebec’s low wage positions are housing, transportation and health insurance.
