Cannabis is legal in Canada: Know the rules

Cannabis is legal for adults in Canada.

Nevertheless, it is still illegal to transport cannabis – as well as all and any products that contain cannabis, as well as those containing CBD – across the Canadian border.

Here, ‘CBD’ stands for cannabidiol, a chemical compound extracted from the Cannabis sativa plant which is commonly known as marijuana.

On October 17, 2018, the Cannabis Act came into force in Canada, putting into place within the country a new and stricter framework for controlling the sale, possession, production, as well as the distribution of cannabis. The Cannabis Act also protects the health and safety of the population through – [1] setting rules for adults for gaining access to quality-controlled cannabis, and [2] creating a new, tightly regulated supply chain.

While legal in Canada, it remains illegal to get cannabis through the Canadian border.

An individual cannot transport cannabis across the border of Canada, regardless of – the quantity being carried by them, even if authorized for medical purposes, or even if travelling to/from an area where cannabis is legal.

If you are entering into the borders of Canada and, for some reason, you are carrying cannabis on your person, you must make sure that you declare the same to the Canada Border Services Agency [CBSA]. Not declaring cannabis in possession at the Canadian border is a serious criminal offence.

Moreover, even sending or receiving cannabis – in any form – into or out of Canada [by courier or mail] is also illegal.

Unauthorized purchases, whether online or through other means, from outside Canada are liable to be confiscated at the border of Canada.

Marijuana or ‘weed’, as it is more popularly referred to, though now legal in Canada, is still illegal to be transported across the Canadian border.
