Skilled immigrant workers who are currently residing in Quebec on Temporary Visas will be prioritized for processing of their applications. There are 3, 700 such applications out of the total 18,000 QSWP applications that are backlogged.
The announcement was made by the Premier of Quebec François Legault. This was to address the contentious move of his government to eliminate the 18,000 QSWP applications that are backlogged.
The Quebec Government was hit earlier this week with a 10-day injunction. This was by the Judge of Quebec Superior Court. The Judge ordered the government to continue with the processing of allocations that are backlogged.
An association of the Immigration Lawyers in Quebec had requested the injunction. It argued that the Immigration Minister is mandated legally to issue decisions on the backlogged applications. The Minister does not possess the discretionary powers of refusal to do so, they added.
On 7 February the Quebec Government tabled legislation called Bill 9. This proposed to immediately dismiss the paper-based QSWP applications. These had been submitted prior to August 2018.
François Legault said that applications of skilled immigrant workers who are already residing in the province will be prioritized for processing. They will nevertheless have to submit the EOI through the online ARRIMA portal. This manages QSWP pool of candidates. He also added that their EOIs will be processed after Bill9 is passed as a law by the National Assembly of Quebec.
Marie Rinfret Quebec’s Ombudsperson has levelled criticisms against the move of the Government. This is in the written brief that has been submitted to the committee in the National Assembly that is studying Bill 9.
The Ombudsperson said that 18,000 applications represent roughly 45,000 individuals. This is when dependent kids and spouses are included. 6,000 of these are residing in Quebec already, said Rinfret, as quoted by the CIC News.
The decision by the Government to dismiss the applications lacks empathy said Rinfret. It is, in fact, a managerial solution to a human crisis, she added.
