US reaches cap for FY22 H-1B petitions, starts accepting applications for FY23 Abstract: The US federal agency confirmed that it had received enough petitions required for the cap on the H-1B visa. It will start accepting applications for 2023. Highlights: On February 28, 2022, the federal agency of the US confirmed that it had received enough petitions required for the cap on the FY22 H-1B petitions. The Congress of the US mandated the cap for the fiscal year of 2022. It will start accepting applications for 2023. The US federal agency said that it had reached the cap on the H-1B visas for the fiscal year of 2022. The notification came one day before the USCIS or US Citizenship and Immigration Services started acceptance of applications for H-1B visas for 2023. The application for H-1B visa for FY2023 starts from March 1 to March 18, 2022. The fiscal year starts of 2023 starts from October 1, 2022.

The Federal Agency of the US says...

The federal agency of the US confirmed that the processing of applications that were submitted before the cap would continue as before. The people who had applied for the visa before the announcement will retain the number before the cap. They are exempted from the counting of applications for the fiscal year of 2022.

H-1B visa in 2022

In 2022, the USCIS conducted visa lotteries three times. According to the mandate, it was done to attain the required sixty-five thousand regular visas and twenty thousand master's cap. In the previous year, two lotteries were conducted by the agency. The action was not per the norm. Usually, the USCIS receives sufficient applications after the selections in the first round. H-1B visas for Indians

 For the past few years, India has reduced the number of workers who can avail of the H-1B visa because of the country's inadequate number of skilled workers even though the American companies are increasing the number of immigrant workers who can apply for the visa as mentioned earlier. The federal agency had stated that most of the people applying for the H-1B visa are Indians. It received more than 2.7 lakh applications from India in the fiscal year of 2021.
