The USCIS recently provided additional guidelines on the new electronic registration process for the H1B Visa for FY2021. The registration process begins at noon EST on 1st March and ends at noon EST on 20th March 2020.
According to the new registration process, registrants (sponsoring employers) and their authorized representatives must first create an online account with the USCIS. The new account can be created by visiting the website https://myaccount.uscis.gov/. Applicants need to select the “ I am an H1B registrant” option on the website. For a smoother process, the US has urged H1B petitioners to create an online account between 24th February and 28th February 2020.
The US is yet to declare when the lottery would take place. However, Immigration Experts believe that the initial selection may be completed by 31st March 2020. Once that is done, the USCIS will notify the registrants on which beneficiaries have been selected. The correspondence will be available on the online USCIS account. Registrants will get 90 days to submit a completed H1B application for the chosen beneficiaries.
The USCIS account may display any one of the below statuses:
The registrant needs to prepare and file the H1B petition for the chosen beneficiary within 90 days
This status refers to the lottery entry being submitted and not the H1B petition. If there are visa places left in the annual H1B quota of 85,000, the USCIS will make additional selections.
This status will not be displayed until the end of the financial year after the lottery process has concluded
This status will appear if a registrant submits more than one application for a beneficiary which is not allowed
The USCIS also explained the suitability for the US Master’s cap. To be eligible for an H1B Visa under the Master's cap, you must have completed your Masters or any other advanced degree from the US. You should complete your Masters no later than three months (90 days) from the day allotted for H1B petition filing after the lottery process is over.
The USCIS has not yet clarified if it would suspend premium processing for H1B Visas as it has done previously.
