On 24th February 2020, Quebec expanded its list of occupations for facilitated LMIA (Labour Market Impact Assessment) process.
Employers hiring foreign workers in Canada need to obtain an LMIA. A positive LMIA is a document that proves that an employer could not find a suitable Canadian worker to fill in a certain job. Hence, the employer needs to hire an overseas worker for that job.
Last year, Quebec released a regional list of occupations with facilitated LMIA. This year, Quebec has released a provincial list accounting for the workforce needs of the entire province.
Quebec has added 116 new occupations to the facilitated LMIA occupations list. 9 occupations had been removed from the list. Some popular occupations added to the list include Architects, HR professionals, Investment Managers, Bakers and Dentists.
Quebec facilitated LMIA occupations list is in collaboration with the Ministry of Immigration. It is based on Canada’s NOC (National Occupational Classification) list.
Before a Canadian employer can apply for an LMIA, he needs to prove that he has made enough recruitment efforts to hire a Canadian worker. One of the proofs is to advertise the open job through various media for at least 28 days. He also needs to interview eligible Canadian workers suitable and willing to work in that job. Only if an employer fails to recruit a suitable Canadian worker, he can then apply for an LMIA.
However, if a Quebec employer is hiring for occupations on the facilitated LMIA list, they do not need to prove their recruitment efforts. They do not need to show that they advertised the position for the stipulated number of days.
The new facilitated LMIA occupation list has come into effect from 24th February 2020.
The following occupations have been removed from the facilitated LMIA occupations list:
