Lottery for IT professionals, U.S. rare second lottery for the H-1B visa

US to conduct rare 2nd lottery for H-1B visa applicants

The U.S. will randomly conduct a lottery for the H-1B visa to decide on the successful applicants. The USCIS (the U.S. Citizenship and Immigration Services) has declared a move for providing a second chance to the Indian IT professionals, who were not able to go through in the first lottery selection.

Hence, it decided to take a second lottery for the H-1B visa successful applicants.

Early in 2021, The US Citizenship and Immigration Services (USCIS) has made the computerized draw for many of the H-1B visas did not give them a sufficient number of Congressional mandated H-1B visas.

Among Indian IT professionals, the H-1B visa is the most sought-after visa, which allows U.S. organizations to employ foreign nationals in specific job roles. These occupations require theoretical or technical expertise. Most of the Technology-driven organizations in the U.S. hire thousands of employees every year from foreign countries like India and China.

To reach the requirements in the Fiscal Year (FY) 2022, the USCIS has to select additional registrations. In order to fulfill this, the USCIS has implemented a random selection process for the second time, i.e., on July 28, 2021.

Based on the number of registrations selected on July 28, the next set will begin on August 2 and close on November 3, 2021. The individuals (selected registrations) will have their myUSCIS accounts, which will provide all the information required selection process along with details on how to file, when to file, etc.

This impressive move by the USCIS is to provide a second chance to several applicants, which also includes hundreds of IT professionals from India.

The federal agency says 'only those petitioners with selected registrations for FY 2022 are eligible to file H-1B cap-subject petitions. The initial filing period for those with selected registrations for FY 2022 was from April 1, 2021, through June 30, 2021.'

The H-1B cap-subject petition should be properly filed at an official service center and should be within the filing period, based on the relevant registration selection notice.

There is no online filing facility for H-1B petitions, instead, they need to file by paper and need to attach the printed copy of the applicable registration selection notice with a subject indicating the FY 2022 H-1B cap petition.

The USCIS added “Registration selection only indicates that petitioners are eligible to file H-1B cap-subject petitions; it does not indicate that the petition will be approved. Petitioners filing H-1B cap-subject petitions, including those petitions eligible for the advanced degree exemption, must still submit evidence and establish eligibility for petition approval based on existing statutory and regulatory requirements.
