Indians cheer as the US resumes 15-day H-1B Visa process

The USCIS has resumed the 15-day H-1B Visa process or Premium Processing. This is good news for Indian professionals seeking US Work Visas in the H-1B category. The Premium Processing has been resumed for all H-1B petitions filed before or on 21 December 2018.

The 15-day H-1B Visa process had earlier been suspended by the USCIS. Its resumption will permit quicker processing of H-1B visa applications.

The Premium Processing offers accelerated service in the form of 15-calendar day processing for specific US Visa applications based on employment. It is for an extra fee of $ 1, 410 that was increased by 15% in 2018.

The fee is above and over all other fees for filing the Visa application. It is however likely that many will opt for it. This is because the current normal processing times for H-1B visas is 5.2 months.

USCIS has been slowly resuming the Premium Processing for limited streams of H-1B applications. It remains suspended for the below H-1B applications received after or on 22 December 2018:

•    H-1B applications requesting changing of employer

•    H-1B applications for amending current H-1B status

•    H-1B applications seeking change of Visa status from one Visa category to another for cases that are not subject to the H-1B cap

It has also been hinted by the USCIS that 15-day H-1B Visa process will be resumed for other categories at the earliest when permitted by its workload. However, it has not given any indications when this can happen, as quoted by the News Bytes App.

USCIS has provisionally suspended H-1B premium processing for 1B cap-subject cases for numerous weeks in the past.
