Canadian immigration rules mandate that prospective immigrants must first obtain a Canada Visa prior to arrival to the nation. However, there is no Canada Fiancé Visa for couples who intend to get married. It means that after the wedding, the Border Officers would expect the Spouse in Canada to file an application for sponsorship. Also, the overseas spouse must get an Immigrant Visa overseas at the Consulate of Canada prior to arrival to the nation.
Accordingly, it does not make a difference if the wedding is held even in Canada or overseas. The overseas spouse must follow proper rules and apply from abroad. If the wedding is held in Canada, the spouse must exit Canada and apply from overseas. They can then return to Canada as a migrant sponsored into Canada.
However, there is a process that can be followed by married couples from inside Canada to obtain PR Visa. This is without having an overseas spouse exiting Canada. It is an exception to the usual requirement of overseas processing. This is based on compassionate and humanitarian grounds, as quoted by the Forbes.
For example, the above ground holds well particularly when the overseas spouse arrives in Canada on Student Visa or Work Visa. In this case, the overseas spouse is present in Canada for lawful reasons. It is not regarded as out of line to ask for inland processing of PR Visa in Canada.
The process is considered to be broken when an individual arrives in Canada on a Temporary Resident Visa as a Visitor. This is due to a semantic issue. It is because of the explanation of a Visitor in Canadian laws.
A Visitor is defined as an individual who arrives in Canada for a provisional time period and leaves after that.
