H-1B Visa registration time close by now

The H-1B Visa registration window will open on 1 April 2019. The petitions for FY 2019 will be capped at 65,000 for those with a Bachelor’s or higher degree. Extra 20,000 Visas will be available for those with a Masters or higher degree.

One new rule has been unveiled by the US Citizenship and Immigration Services for this year. This aims to increase the selection of applicants in the lottery who have a Masters or higher degree. They will get the chance to participate first in the general draw for 65,000 Visas.

The individuals who do not get a Visa in the general draw will get another chance in the advanced degree draw for 20,000 Visas. This reverses the order in which the H-1B lottery has been conducted until now, as quoted by the News OK.

Employers must begin the process for submitting fresh H-1B petitions. This is for workers whom they want to transition to H-1B status. The H-1B Visa registration for cap-subject petitions will begin on 1 April 2019.

The H-1B petitions will be accepted by the USCIS only for 5 business days. The applications must be submitted in the initial days itself. This is because USCIS will stop accepting applications on the 5th day. It is if the agency receives extra petitions than the cap number in the first 5 days itself. This has been actually occurring every year from 2013.

The deadlines for the H-1B Visa registration are fixed and preparing the applications does take time. So the employers must begin collating details and start filing the applications at the earliest.

A new application system for the H-1B lottery will also commence from FY 2020. From this year, all petitions for capped 65,000 quotas and extra 20,000 quotas will have a streamlined process. They will not be required to file a complete petition to the USCIS. Only those applicants who are chosen in the lottery will have to submit complete H-1B applications.
