US launches streamlined H-1B visa renewal process under the pilot program

The United States has launched a domestic H-1B visa renewal pilot program, allowing eligible citizens of India and Canada to renew their work visas without leaving the country. The program is set to begin from January 29, 2024, through April 1, 2024, or until all the available slots are filled.

 

20,000 application slots will be offered during the H-1B pilot program

The Department of State will offer up to 20,000 application slots during the pilot program. Approximately 2,000 slots per week will be allocated to applicants based on the issuance date of the recent H-1B visa by U.S. Mission India (February 1, 2021, to September 30, 2021) and U.S. Mission Canada (January 1, 2020, to April 1, 2023).

 

Application slot dates for H-1B visa under pilot program

Application slots are released on specific entry period dates:

  • January 29, 2024
  • February 5, 2024
  • February 12, 2024
  • February 19, 2024
  • February 26, 2024

The deadline for all applications is April 1, 2024. Candidates may reapply on the remaining dates of the entrance season if they miss one application date.

Steps to apply for pilot program

  • Select the nation where recent H-1B visa was obtained
  • Use the online navigator tool to determine eligibility
  • Fill out and submit the online non-immigrant visa application (form DS-160) if eligible
  • Pay the $205.00 mandatory non-refundable Machine-Readable Visa (MRV) application processing cost online
  • Follow portal instructions for mailing the passport and required documents for processing

After receiving the passport and necessary documents, the Department estimates a processing time of five to eight weeks.

 

Eligibility to participate in the pilot program

Participation in the pilot program will be limited to applicants who:

  • Seek to renew only an H-1B non-immigrant visa
  • Have the H-1B visa issued by U.S. Mission India (February 1, 2021, to September 30, 2021) or U.S. Mission India (February 1, 2021, to September 30, 2021)
  • Are exempt from the non-immigrant visa issuing charge (reciprocity fee)
  • Are qualified for an in-person interview waiver
  • Have provided 10 fingerprints for a previous visa application
  • Previous visa is not annotated with clearance received
  • Do not possess a visa ineligibility requiring a waiver
  • Have entered the US recently on the H-1B visa and are currently in the country with H-1B status
  • Possess an approved and valid H-1B petition
  • The authorized entry period in H-1B status has not ended
  • Plan to return to the U.S. in H-1B status after a short stay elsewhere

 

Documents to be submitted H-1B visa under pilot program

  • DS-160 barcode sheet
  • Passport valid for at least six months beyond the visa application date
  • Non-refundable $205.00 MRV application processing fee
  • One recent photograph
  • Copy of current Form I-797, Notice of Action and copy of Form I-94, Arrival-Departure Record

Most applicants are also eligible for an in person interview waiver except for certain categories and those will not be eligible for a waiver and will not be permitted to take part in the pilot if they do not live in the US, had a visa denial before, and if they appear to be ineligible for a visa.
