  • In accordance with the SFA, the IRCC has increased visa application fees for returning migrants.
  • The increase applies to certain applications and candidates can receive a partial refund if service standards are not met.

Application Fee Increase for Returning Foreign Nationals

IRCC has increased the application fees for foreigners who are willing to return to Canada after being denied entry or on regaining their status. This is in accordance with the Service Fees Act, ensuring that the fees are updated annually.

Candidates are eligible on getting partial refunds if service standards are not met. Applicants submitting their requests on or after December 1st, 2023, will be eligible for these refunds.

Inadmissibility rules in Canada

Foreign nationals need to fulfil specific conditions and requirements in Canada in order to be admissible, which includes passing a criminal background check before entering the nation. The Canadian Border Services Agency and IRCC have the authority to deny the entry of any foreigner who they feel is not appropriate.

There are three primary methods to overcome Canada's inadmissibility rules:

Temporary Resident Permit (TRP)

A TRP or Temporary Resident Permit allows temporary entry into Canada which is for a certain period of time. This is issued to candidates who have a valid reason to enter Canada, and is valid for up to three years.

Criminal Rehabilitation Application

Candidates can submit an application for criminal rehabilitation which completely clears any record allowing them entry into Canada.

Legal Opinion Letter

Individuals facing charges can avoid inadmissibility by submitting a legal opinion letter to the court handling their case.
