The impact of the separation of Canadian PR

Individuals must sign an agreement before agreeing to be a sponsor, which promises that financial support will be provided for the basic needs of their partner or spouse and their dependent children. Basic needs include food, clothing, shelter, and other needs for daily living. Health needs that are not covered by public health services.

Before signing the agreement, you must ensure that the person you are sponsoring will not ask the government for financial help.

The most important thing to consider before signing the agreement is to take the responsibility to support the applicant for the undertaking period, even if your situation changes.

 

The agreement cannot be canceled, even if:

  • You become divorced or get separated from your relationship
  • You or your sponsored person moves to another country
  • Financial problems
  • The sponsored person becomes a Canadian citizen

What do you do if the relationship is not real?

The applicant must submit certain documents to prove that the relationship is real. Documents that need to be submitted include proof of joint ownership of residential property, wedding invitations, or documents like cell phone bills or tax forms showing the applicant and sponsor live at the same address or have joint accounts.

A partner relationship or common law partnership that is not real or that was entered into primarily to acquire any status or privilege will be refused. IRCC officers in Canada are educated to recognize real immigration applications. Permanent residents or Canadian citizens in a marriage of benefit for immigration reasons may be charged with a crime.

Many situations are there where a Canadian citizen is a victim of marriage fraud. Marriage fraud will be found once the sponsorship is complete. Once the sponsorship is granted permanent residence, the sponsored person will end the marriage or relationship.

 

IRCC can:

  • Charge them with a crime
  • Ban them from Canada for 5 years
  • Remove them from Canada
  • Take away their status as a permanent resident or Canadian citizen.
