Yes, foreign skilled workers can move to the US with the EB-1 visa, the US first preference employment-based green card. For most foreign nationals, there are two main categories of options when seeking a Green card: family- and employment-based. Individuals who don’t have family members in the country can apply through the employment-based option. The employment based visa is EB-1 visa. For EB-1 visa an applicant is required to demonstrate qualification that is internationally recognised or national acclaim in their field. This visa is open to skilled professional across various fields, including sciences, education, arts, business, and athletics. The EB1 green card grants successful applicants the US Green Card.

EB-1 visa

EB-1 visa is a visa category for foreign skilled workers with extraordinary ability. This visa has subcategories that provide green cards to candidates with exceptional skills in science, athletics, athletics, art, business, or multinational managers.  There are other sub-categories that a skilled professional can apply for according to their visa requirement.

Eligibility Criteria to apply for EB-1 visa

Here are the eligibility criteria for an EB-1 visa:

 

For EB-1A visa

  • Must be able to demonstrate extraordinary ability in –

 

  1. Arts
  2. Athletic
  3. Business
  4. Education
  5. Science

 

  • Evidence can be provided for a 1-time achievement such as an Oscar, Olympic Medal, Pulitzer Prize, etc.
  • The individual must also show evidence that they will continue to work in their area of expertise.
  • No offer of employment in the U.S. is required.
  • No labor certification is required.

 

For an EB-1B visa

  • They must show that they possess international recognition for outstanding achievement in a specific academic field.
  • A minimum of 3 years’ experience in teaching or research – in that academic area – would be required.
  • The purpose of seeking entry into the U.S. should be to pursue tenure, a research position, or tenure-track teaching at a higher education institution, private employer, or university.
  • An offer of employment from the prospective U.S. employer would be required.
  • No labor certification is required.

 

For EB-1C visa

  • Must have been employed outside the U.S. for at least one year within the three years preceding the petition.
  • Those already working for the U.S. petitioning employer must be the most recent lawful non-immigrant admission.
  • The petitioning employer must be a U.S. employer intending to employ the individual in an executive or managerial capacity.
  • No labor certification is required.

  • Complete the medical examination.
  • Arrange the supporting documents.
  • Attend the EB-1 visa interview.
