Foreign nationals in the United States have an immigrant visa immediately available to others as an EB-1 visa, EB-2, or EB-3 immigrant visa. They can adjust their status in the country. To change the applicant's status, they must file an I-485 application to register as permanent residents or adjust their status. This is the most common pathway to change the status visa status of an EB-1 visa to a Green Card. Other than that, there are two pathways through which the EB-1 visa status can be changed to a Green Card.

Ways to change an EB-1 visa to a Green Card

To change an EB-1 visa to a Green Card involves applying for other immigrant visa categories, such as family-sponsored and investment immigration classifications. Here are some ways to change an EB-1 visa to Green card:

 

Immediate Relative (I.R.) Green Card

The Immediate Relative (IR) category is for U.S citizen family members. If an applicant falls under the following subcategories, they can change their status from EB1 to Green Card through the I.R. Visa:

 

  • IR-1 visa: This visa is for foreign spouses of U.S. citizens who have been married for more than two years.
  • IR-2 Visa: This visa is for U.S. citizens who have unmarried children who are under 21
  • IR-3 Visa: This visa is for children adopted by U.S. citizens abroad
  • IR-4 Visa: This visa is for children adopted by U.S. citizens in the United States
  • IR-5 Visa: This visa is for U.S. citizens, foreign parents

 

Requirements to apply for Immediate Relative (I.R.) Green Card

Below are the requirements for applying for an immediate relative (I.R.) Green Card:

 

  • Immigrant Petition: Form I-130 (Petition for Alien Relative) is filed to the USCIS
  • Adjustment of the status or online immigration visa application: Form I-485
  • Complete U.S. Citizenship and Immigration Services or Visa interview
  • Proof of relationship
  • Sponsorship approval
  • D. proof
  • Medical Insurance
  • Birth certificate
  • valid passport
  • Slip of Fee payment
  • Approval of Form I-485 or DS-260

 

EB-5 Green Card

The EB-5 visa is in the same category as the EB-1 Visa under the Employment Immigration Visa. It is a category of Green Card for eligible applicants who can invest a minimum amount of $800,000 in a Targeted Employment Area project. The minimum investment must result in the creation of at least ten full-time jobs for U.S. workers.

 

Changing from an EB-1 Visa to an EB-5 Visa through TEA projects also qualifies you for reserved visas and priority processing of your initial petition, which is highly advantageous for shortening the Green Card application process. After deciding on your EB 5 Project investment, an applicant must fulfil the requirements to change to EB 5 from EB 1 visa.

 

Requirements to apply for EB-5 Green Card

Here are the requirements to apply for EB-5 Green Card:

 

  • Must provide an investment of $1,050,000 as capital investment and $800,000 in a rural area infrastructure project
  • The investment must be for U.S. profit commercial entity
  • Investment must create full-time U.S. jobs for two years

Here are the general requirements that must be fulfilled to change an EB-1 Visa to a Green Card:

 

  • Completed application of Form I-130

  • Police clearance certificate
