The EB-1 visa is called the Employment-Based first preference visa which is issued for foreign nationals with exceptional abilities (science, arts, education, business or athletics) as well as for those with extraordinary abilities, an outstanding researchers or professors, or managers and executives of multinational organizations.

 

The USCIS requires that applicants for the EB-1A visa either:

 

  • To prove that they won a significant international award
  • To prove their extraordinary abilities in three qualifications out of ten categories.

Foreign nationals who are eligible for extraordinary ability

To be considered an applicant of extraordinary ability, they must prove their extraordinary achievement in fields such as science, arts, education, business, or athletics with national or international recognition.

 

The applicant must also provide correct documentation to demonstrate the accomplishment. This visa is reserved for individuals who have reached the highest achievement in their field and renowned in their respective fields. The essential factors that can demonstrate extraordinary abilities:

 

  • Proof of experience and knowledge in their field
  • National or international recognition
  • Fulfil the requirements to prove the eligibility
  • Completion of multiple criteria

 

Criteria for demonstrating extraordinary ability for an EB-1 visa

Applicants can meet the criteria by providing significant achievement awards for e.g. Oscar, Pulitzer Prize, and Olympic Medal or by fulfilling any three criteria. Below mentioned are the criteria that must be presented to prove the Extraordinary Ability for an EB-1 visa:

 

  • Proof of receiving international or national recognized award for their achievement
  • Associated with the extraordinary acquire groups
  • Published works professional journals for major media
  • Be invited as a judge for recognised organisation related to their field
  • Significant contributions of central importance in science, arts, education, business, or athletics
  • Writing scholarly articles in major media or professional publications
  • Display of work in artistic exhibitions or showcases
  • Leading or critical role in a distinguished organization
  • Commanding a high wage in the field
  • Blooming success in performing arts

 

Criteria for demonstrating as an Outstanding Researcher or Professor

Applications can also file for an EB-1 visa if they are an Outstanding Professor, Researcher, Executive, or Manager. To qualify as an Outstanding Professor or Researcher, an international recognition in a specific academic field, at least three years of teaching or research experience, and an employment offer from a U.S. employer is required. The proof of evidence must support at least two criteria to apply for EB-1 visa: 

 

  • Proof of recognised awards for extraordinary achievement
  • Be a member of outstanding achievement association
  • Other authors must criticize the candidate’s educational writing
  • Original scholarly or scientific research contributions in the field
  • Authorship of articles or scholarly books in international business
