Australia PR for Spouse

Australia PR is a status that allows visa holders to legally live and work in Canada. Spouses or partners of an Australian PR, Australian Citizen, or an eligible New Zealand Citizen can apply for Australia PR through the following pathways:

  • Subclass 100
  • Subclass 820

Subclass 100

Subclass 100 is an Offshore Partner Visa. Applicants through this pathway must apply for Australia PR from their home country. This visa allows the applicant to reside in the country permanently.

 

Eligibility

To apply through Subclass 180, the applicant must meet the following criteria:

  • The applicant must be either married or in a de facto relationship with their partners.
  • If the applicant is married, the marriage should be legally acceptable in Australia.
  • In case of a de facto relationship, the applicant must have been in the relationship for a minimum of one year.
  • The applicant’s partner should be either an Australian Permanent resident or a citizen.

Requirements

  • Must be above the age of 18
  • Should be sponsored by their partner
  • Must be a temporary partner visa holder (Subclass309)
  • Meet the character and health requirements

Subclass 820

Subclass 820 is an Onshore Partner Visa. Through this pathway, the applicant needs to apply from within Australia. This visa allows the applicant to stay in the country temporarily.

 

Eligibility

  • Must be married to their partner or be in a de facto relationship
  • If married, it should abide by the Australian laws of marriage
  • If in a de facto relationship, then should have been in the relationship for at least 1 year
  • The applicant’s partner must be an Australian Citizen or an Australian PR

Requirements

  • Must be 18 years or above
  • Must be in Australia while applying
  • Must be a holder of another visa type, such as a student, visitor, or working visa
  • Must not have the no further stay - 8530 condition
  • Meet the health and character requirements
  • Must be sponsored by their partner

Processing Time

The processing time for the Subclass 820 is 23 - 30 months.

 

Process Fee

The processing fee for Subclass 820 is AUD 8,850. If children are applying, each child will pay an additional fee.
