USCIS warns multiple H-1B visa applications to be rejected

Multiple H-1B visa applications will attract rejections warned USCIS, the federal US agency. The US Citizenship and Immigration Services has cautioned the prospective applicants of H-1B visas. The process of accepting H-1B visa applications has commenced from 2 April 2018. This visa is hugely popular amongst the IT professionals in India.

USCIS has said that it will enhance scrutiny of multiple H-1B visa applications. It said that upon noticing the same, the approval of all H-1B visa applications that are subject to the cap will be denied or revoked if multiple applications are filed for one applicant by associated entities except for genuine needs of the business.

The federal US agency that is responsible for all US visa applications processing said that multiple H-1B applications challenge the lottery process integrity, as quoted by the Indian Express. USCIS announced policy guidelines for H-1B visa applications. This clarifies on the manner in which the term associated entities was applicable to barring the multiple H-1B visa applications.

Associated entities will include petitioners even if they are or not related via corporate control and ownership. These file H-1B visa applications on behalf of the same applicant for virtually the same job under the cap-subject allotment. This does not have any authentic need of business supporting several applications for the same beneficiary, added the USCIS.

USICS said that a single employer cannot submit more than a single application subject to the cap for the same applicant even if there is a genuine need for business. It meanwhile also accepted that rarely an employer can also have an authentic business need. This may make the employer file 2 or more individual H-1B applications on behalf of the same overseas immigrant.
