Many US States and Immigrant associations have declared that they will file a legal suit against Trump’s decision to abolish DACA immigrant amnesty program. The DACA program protected immigrants who arrived to the US illegally as kids from being deported.
State Attorney Generals of US states that include Massachusetts, Washington, New York, and California said that they will be filing a lawsuit in defense of the DACA program. This immigrant amnesty policy was launched by the then US President Obama to protect workers in the US who arrived at the nation as kids illegally.
Maura Healy the Attorney General of Massachusetts said that the state will defend the DACA program and fight for the rights of the DACA workers. Several immigrant associations across the US have criticized the decision by Trump to end this program.
The National Immigration Law Center, one of the Immigrant associations supporting the DACA has already filed papers in the court blocking Trump’s decision. It has asked to amend a current lawsuit that is pending in New York. This lawsuit was filed in 2016 on behalf of an immigrant from Mexico Martin Batalla Vidal who was a recipient of DACA. He had arrived in the US at the age of 7, as quoted by the Times of India.
In the fresh lawsuit, the attorney representing Vidal said that the action by Trump to end DACA is challenged on two grounds. Trump’s decision goes against the federal Administrative Procedure Act in the US. This law mandates that the administration must adhere to established procedures when it intends to effect crucial changes in policy. The attorney also said that announcement by Trump was a sudden change in policy.
