US L-1 Visa employers are facing more number of surprise site visit programs by the United States Citizenship and Immigration Services as per the latest report. Site visit program involves spontaneous visits by USCIS agents at immigrant work sites. It is done for specific categories of US Work visas to assess compliance with visa rules in the US.
The last time the USCIS announced its plans for expanding the site visits was in 2014. This included assessing workers who possess Religious worker R-1 Visa and US L-1 Visa for executives and managers. While announcing the site visit program in 2014, the USCIS said clearly that it was for exclusively for US L-1 visa employers.
On the other hand, Bloomberg Law revealed in its report that USCIS is conducting surprise site visits now. It is for US employers utilizing the L-1B visa for expert knowledge workers too, as quoted by the Workpermit.
L-1 Visa rules for both managers and executives and for L-1B expert knowledge workers are highly intricate. It is not much tough for an employer to have non-compliance issues. In spite of taking all required measures for L-1 visa compliance, it is likely that US L-1 Visa employers face issues.
The regulations for a visa in the US are mostly the most intricate when compared globally. Initiatives for simplifying the visa regime must be taken by the US Congress. US visa law compliance becomes arduous as hardly any person comprehends the requirements for the visa. Visa requirements are so vulnerable for interpretation.
It has been revealed that USCIS has refused to give a statement on the latest site visit program. On the other hand, it directs individuals to the website and the Program for Administrative Site and Verification’. Even though it is confirmed by the website that L-1 site visits are held by the USCIS, there is no differentiation between the L-1A visas and L-1B visas.
