The US Judge at District level in New York has ruled against the decision of Trump in the DACA issue. Nicholas Garaufis ruled that Deferred Action for Childhood Arrivals - DACA Program cannot be terminated on 5th March 2018. This date had been fixed by US President Donald Trump. It is a legal win for the Attorneys of the Democratic-ruled states and immigrants who filed a lawsuit against the US Government.
The New York federal US Judge ruled that administration led by Trump has failed to provide sufficient legal reasons for ending the DACA program. It shelters millions of immigrants from being deported. These had arrived in the US illegally as kids, as quoted by the Indian Express.
The current debate in the US Congress over transforming the US Immigration laws is further complicated by the legal tussle over DACA. The appeal of the US administration in the US Supreme Court against the San Francisco ruling is due to being considered on 16 February 2018. The court will decide whether it will allow the appeal or not.
Nicholas Garaufis the US District Judge said in his order that the US President unquestionably possess the power to end the DACA program. But he was relying on a faulty legal position in taking this decision, he added.
Attorney General for Trump said that the former US President Obama unconstitutionally exercised his authority in implementing the DACA program. On the other hand, the US Judge said that US administration led by Trump was reliant on wrong belief that the program was unconstitutional.
Immigrants who are currently covered in the DACA program must continue to enjoy protections, ordered the judge to the US administration.
