The H1B Visa is a non-immigrant visa which is issued to foreign workers working in US companies. The H4 Visa is issued to the spouse or dependent children of an H1B Visa holder.
The H1B Visa allows US companies to recruit foreign workers in specialized occupations. These occupations may require technical or theoretical expertise. The H1B Visa is the most sought-after Visa among IT professionals in India.
The USCIS plans to come out with a new H4 Visa proposal by early next year. The proposal mulls the removal of certain H4 Spouses eligible for work authorization from its regulations.
Almost 70,000 H4 Visa holders have work permits in the US. This new proposal could potentially make a major impact on them.
The USCIS has written to top US lawmakers over the Trump government’s decision to revoke the H4 Visas. The USCIS has also written a similar letter to the leaders of the corporate sector who have raised concern over the government’s decision.
USCIS director, L Francis Cissna, wrote to Kirsten Gillibrand and Kamala Harris, Senators, on 16th Oct.
The letter said that during a notice and comment period, the public would be able to provide feedback. The feedback will be taken on proposed regulations or revisions on H4 work authorizations.
Both the Senators have urged the Trump Govt. to not revoke the H4 work authorization.
The USCIS letter, however, does not commit on the H4 Visa’s fate, as per The Times of India. All it says is that the DHS is committed to protecting the integrity of the US immigration system. It also commits to protecting the job opportunities and wages of the US workers.
