The US to alter H1B Visa norms for Overseas Immigrants

On November 30 2018, the US has proposed changes to its H1B Visa process. The H1B Visa will now be aimed at the most skilled and highest paid Overseas Immigrants. Also, companies will have to register their petition online.

H1B Visa is most popular in countries like China and India. Tech companies in America depend on this Visa to hire thousands of employees from these countries. Companies willing to hire Overseas Immigrants must register with US Citizenship and Immigration Services (USCIS). There is a designated registration period for that.

Every year the US sets a cap of 65000 H1B Visas. The first 20000 petitions filed would be exempt from the cap. However, the US is now going to change the order in which it chooses the petitions.

The Department of Homeland Security (DHS) said that it will increase the number of talented Overseas Immigrants in the country. Only Overseas Immigrants with higher degrees or education can enter the US.

Currently, the selection order of the H1B Visa petitions is -

* At first, those submitted for advanced degree exemption are selected

* Those reaching the H1B Visa cap are selected later

This order will be reversed, confirmed the DHS. They will wait for enough number of petitions for the H1B Visa cap. Only after that, they will select the ones submitted for advanced degree exemption. This will ensure Overseas Immigrants with higher education are selected.

As quoted by Financial Express, this change would bring nearly 5350 more Overseas Immigrants to the US. USCIS said the online registration process would reduce the cost and simplify the process. Also, this would reduce the burden of handling thousands of documents on the USCIS. This, in turn, will minimize the wait time for Overseas Immigrants.

The new norms would also enhance the integrity of the H1B Visa system. Because it limits the filing of petitions to the beneficiary. The US President Donald Trump insisted that these changes would help the country and its job market. The H1B Visa should be awarded to only the most skilled Overseas Immigrants. This would also protect the interests of the US workers, he added.
