U.S. may not conduct a second draw of H-1B visa lottery for FY23

Highlights of H-1B visa lottery for FY23

  • The US may not hold a second lottery for H-1B visas.
  • USCIS has not made any formal announcement for not conducting the second lottery
  • USCIS received 483,927 H-1B cap in FY23
  • USCIS selected 127,600 registrations for meeting H-1B quota

No second lottery may be conducted for H-1B visa

The United States may not conduct the second lottery for the H-1B visa for the fiscal year which will end on September 30, 2023. TOI has reported that due to non-selection notices about the H-1B cap, there is an indication that a second lottery may not be held. USCIS has not made any formal announcement regarding the second lottery.

Number of registrations received

In this fiscal year, the US has received 483,927 H-1B cap registrations. USCIS selected 127,600 registrations to meet the quota of H-1B visas. The period in which the registration window was open was March 1, 2022 and March 18, 2022.

USCIS will use the online selection process

The H-1B cap is applied to all the first-time H-1B petitions. USCIS will randomly select H-1B registrations to meet the cap. Last year, three lotteries were conducted by USCIS. These lotteries were conducted to meet the cap of 65,000 for regular visas and 20,000 under master’s cap. The fiscal year followed by USCIS is from October to September. Candidates who will be selected can work in US from October 2023.

Shortage of high-skilled tech talent

It has been observed in the last few years that Indian companies have reduced the proportion of workers employed on H-1B visas. American tech companies are increasing the number of people to come to the country. There is a shortage of high-skilled tech talent in the US and this has led to high demand of workers to work for technology roles.
