Effective from October 3 all H-1B visa extension of stay petitions can now avail Premium Processing from the US Citizenship and Immigration Services. With this, all types of H-1B visa petitions can now avail the fast track visa premium processing by the USCIS.
Skilled workers are availed by the firms in the US for a wide range of jobs including IT, Mathematics, and Engineering. A 15-day calendar processing time is guaranteed by the USCIS when the premium processing is requested by a petitioner, as quoted by the USCIS Gov. The agency will return the fee for premium processing and continue with the fast-track processing if it fails to adhere to this timeline.
With the receipt of the current format of Request for Premium Processing Service I-907 Form, the 15 calendar day period of the USCIS begins. The form must have the accurate filing address. Within the 15 days period open an investigation for fraud, a request for evidence, a notice of intent to deny, a denial notice or an approval notice will be issued by the USCIS.
A new 15-day calendar will commence if the application requires the response to a notice of intent to deny or submission of additional evidence. This is now applicable to all H-1B visa extension of stay petitions.
US Citizenship and Immigration Services had resumed earlier premium processing of H-1B visa petitions subject to the yearly cap in addition to the resumption of all H-1B visa extension of stay petitions from October 3. The earlier resumed premium processing includes physician’s applications via Conrad waiver, inclined government agency exemptions and some applications for H-1B visa that are not subject to an annual ceiling.
