Brazil eases Work Visa rules for overseas workers

Brazil has eased Work visa rules for overseas workers through the 72/2017 Normative Resolution. It has altered the rules that are applicable to immigrants working on board on the overseas platforms or vessels. In order to obtain a provisional visa, they have to now apply for Authorization of Work Residency. Earlier, these were required to apply for a Work visa, as quoted by the International Law Office.

It is important to note here that Work Residency Visa can be gained:

  • Prior to arriving in Brazil implying the immigrant can obtain the visa from the Consulate; or
  • In Brazil by submitting an application for Residency Visa from the Federal Police

The eased Work visa rules for immigrant workers have been welcomed by the industry in Brazil. An immigrant who is already in Brazil in another category of visa and intends to work need not leave the nation. They can submit an application with the Labor Ministry for Residency visa.

Once the immigrant receives the Residency visa from the Labor Ministry, the application for transition of the visa to the Work Residency Visa must be submitted. This must be dome through the Brazil Federal Police.

Provisional visas are still needed for migrants working onboard on overseas vessels or platforms. The 72/2006 resolution mandated that individuals must have a work visa before receiving a provisional visa. On the other hand, 6/2017 resolution requires immigrants to have Work residency visa to obtain the provisional visa.

The 6/2017 resolution maintains the rule for a minimum number of naval or other Brazilian professionals that must be working on board on overseas oil vessels or platforms. This is if they intend to operate in Brazil sea limits for more than 3 months.
