Who is eligible for an Australia Partner Visa?

The spouses or de facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens can apply for the Australia Partner Visa. The visa is specifically designed to provide permanent resident status to the partners of Australian citizens and PRs. There are two categories of the visa: Subclass 820 (Temporary) Partner Visa and Subclass 801 (Permanent) Partner Visa. Candidates eligible for the partner visa can apply together to migrate and reside in Australia with permanent resident status.

Australia Partner Visa Eligibility Requirements

You would be eligible for the Australia Partner Visa (Subclass 820 and Subclass 801) if you meet the following requirements:

Genuine Relationship: You must demonstrate a genuine marital or de facto relationship with your partner and provide substantial and verifiable proof. The documents that can be used as a proof of relationship are as follows:

  • Joint bank accounts
  • Child birth certificates or adoption certificates
  • Joint rental receipts
  • Wedding certificates (if applicable)
  • Joint ownership of residency
  • Proof of sharing the same accommodation
  • Details of traveling together
  • Joint utilities accounts
     

Mutual Commitment: You and your partner must be committed to the relationship. Your relationship must either be recognized as registered under Australian law, or you must be living together on a genuine and ongoing basis, demonstrating a committed relationship.
 

Financial support: The partner who is an Australian citizen or PR holder in Australia must demonstrate enough financial resources to support themselves and their family without relying on financial aid or government assistance. Although no minimum bank balance requirements are specified for an Australia Partner Visa, it is necessary to prove financial stability. The documents that can be used to prove financial stability include:

  • Recent bank statements
  • Documents showing your source of income
  • Tax returns and payment receipts
  • Proof of assets
  • Loan certificates or letters
  • Saving accounts statements
  • Letters for employers showing annual salary
     

Sound health and character: Along with all other requirements, you and your partner must demonstrate a clean character and be medically fit for immigration. Both partners must meet health and character requirements and provide documents such as medical fitness reports and police clearance certificates to support their statement.|
