The U.S. Citizenship and Immigration Services (USCIS) are all set to accept applications of H1B Visa 2015 from April 2014 save upon the changes in the new immigration bill in USA.
H1 B Visa Application Filling Starts from April 2014
Only employers can apply for the H1B visa application. The filing date for H1B Visa FY 2015 would begin from April 1, 2014. However, the authorities concerned have stated that they have no clues about the impact of changed laws as the overhauled immigration bill is still in the house and it has not been passed. And if passed the authorities and people all across the globe would have to comply with the changes.
The H1B Visa would be accepted from April 1, 2004 to October 1, 2014. The dates for filling of application forms are liable to change.
3 Caps of H1B Visa
Under the regular cap 65,000 H1B Visa are available-1,400 H1B visas for Chileans and 5,400 for Singapore nationals. Advanced Degree Cap for Masters and higher degrees from USA can be availed. These are 20,000 in number. Third one is ‘no quota’ which includes cap-exempt companies such as Non-Profit Organizations.
H1B Visa Approval Process
The procedure starts with Department of Labour for LCA approval, further with the Department of Homeland Security, which includes USCIS, U.S. Customs and Border Protection (CBP), and U.S. Immigration and Customs Enforcement (ICE), and finally you need to deal with the Department of State for issuing of visa.
So, the employers have to basically deal with the Department of Labor and USCIS.
Preparation of H1B Visa 2015
Preparation of H1B Visa application varies from immigration attorney to attorney but usually for the first five days, the immigration attorney collects documents and frames LCA application. Then this is followed by the filing of LCA, and further preparing the H1B applications. In the meanwhile, the LCA is being processed. This is followed by the filing of H1B Visa Application.
Regular and Premium Processing
There are two types of processing mechanisms-regular and premium. USCIS speeds up the process of H1B Visa if an additional amount of $1225 is paid. In this case H1B Visa can be received within 15 days whereas regular H1B Visa processing takes two to four months.
According to the authorities concerned, this year the visa application receipt would be received by June but this would also depend upon the number of applicants.
As soon as the approval for the visa is given, the employer receives I-797 Approval Notice encapsulating the Start and Expiry Date ofH1B petition.
