Last month, we published an article to remind you to start your US H-1B as early as possible. In this article though, we would like to clarify what the H-1B visa is, in detail for all our clients who have had questions on this particular visa.
The H-1B visa permits US businesses to enlist remote labourers to work in skilled occupations. A 'skilled occupation' is a professional work profile that requires practical or theoretical uses of an assortment of very specific information. Skilled occupations incorporate educators, engineers, accountants, computer language developers and academic researchers. Occupations that meet all requirements for a H-1B visa require a lot of education and experience. For most Indian applicants though, the Information Technology sector is the largest demanding industry.
Accepting that an employer has a skilled occupation position open and a qualified skilled immigrant who fits the profile, we should then be concerned with the H-1B cap. The H-1B project is constrained to 65,000 new H-1B visas this year. Likewise, there are an extra 20,000 visas accessible for skilled immigrants who have earned a Master's degree or higher from a college in the US, bringing the grand total to 85,000. These cap numbers have been set by the US Congress.
The H-1B applicant is the business concern or the proprietor. A major aspect of the appeal for the visa, the business must show not just that the position qualifies as a skilled speciality, that the foreign immigrant is qualified to perform the job. However, presenting your appeal on April 1st does not guarantee that it will be accepted.
