The Australian Partner visa, or the spouse visa, allows an Australian citizen or permanent resident holder to bring their non-Australian spouse or de facto partner to stay with them in Australia. The applicant must be in a genuine or committed relationship with the sponsor.
 

The Australia partner program offers temporary (Subclass 820/309) and permanent (Subclass 801/100) partner visas for spouses or de facto partners. In the case of temporary partner visas, subclass 820 is issued for onshore applicants, and subclass 309 is issued for offshore applicants. In the case of permanent partner visas, subclass 801 is issued for onshore applicants, and subclass 100 is issued for offshore applications.

Australia Temporary Partner Visa

The temporary partner visas are of two types based on the applicant's location: Subclass 820 (onshore) and Subclass 309 (offshore). The key features of the visa are given below:
 

  • The visa allows spouses or de facto partners of Australian citizens or permanent residents to stay with them in Australia
  • You can live, work, study, and research in Australia till you receive your permanent visa
  • The duration of the stay is limited. Visa holders have to extend the validity of the visa before it expires
  • You will have access to Australia’s public healthcare scheme, Medicare.
  • You are eligible to attend English language classes offered by the Adult Migrant English Program
  • The visa is a pathway for permanent residence, given you meet specific requirements

The permanent partner visas are of two types, based on the location of the applicant: Subclass 801 (onshore) and subclass 100 (offshore).  The key features include:
 

  • The visa offers permanent residency status, allowing you to stay indefinitely in Australia
  • You can work and study in Australia without any restrictions
  • You can access Australia’s public healthcare scheme, Medicare
  • You can sponsor eligible family members for permanent residence in Australia
  • The visa provides a pathway to Australian citizenship, subject to meeting eligibility requirements
  • The sponsor must provide proof of financial support for the applicant

Requirements for an Australia Partner Visa

The requirements for an Australia Partner visa are given below:
 

  • You must be at least 18 years old
  • You must be in a genuine, ongoing, and committed relationship
  • You must be married, or in a de facto relationship (minimum 12 months), or have a registered relationship
  • Your sponsor must be an Australian citizen or a permanent resident
  • You must meet health and character requirements
  • You must provide proof of your relationship
  • You must have a police clearance certificate
