Can H-1B visa holders work on 1099?

People are not allowed to work as independent workers with the Form 1099 while they hold an H-1B visa. The employee - employer relationship under the H-1B visa are same as the standards for STEM OPT extension for the F-1 Visa. The employee is obliged to stay as they are being sponsored by their employer. The H-1B visa holders are not permitted to accept contracts out of the H-1B visa sponsor work. This means that the income earned through the H-1B visa falls under the employment-based income category.

What is Form 1099?

• The H-4 visa holders, who are the dependents of the H-1B visa holders and have a permit from the Employment Authorization Department, can work under Form -1099.
• Once the applicant receives the permit, H-4 visa holders are allowed self-employment and can run a business as a sole proprietor, which is covered by Form 1099.
• However, the H-1B visa holders can work under Form 1099 once they become green card holders.
• The O1 visa holders who are independent contractors earn based on the Form 1099.
