Australia’s New Student Visa Rules: Indian Students Face Changes to onshore Applications and Family Visas
Australia’s student visa rules changed on 2 October 2026. Most applicants must now apply from outside the country, while most can no longer include partners or dependent children unless an exemption applies. Here is what Indian students need to know.
Australia has introduced changes to its student visa (subclass 500) and Student Guardian visa (subclass 590) application rules, affecting where applicants can lodge applications and whether they can bring family members. The changes took effect on 2 October 2026, according to Australia’s Department of Home Affairs. They are particularly relevant to international students already in Australia who intend to apply for another Student visa, as well as prospective students planning to relocate with their families.
The government has also clarified that applications lodged before the changes took effect will continue to be assessed under the rules that applied when they were submitted. For Indian students, the immediate priority is to check eligibility and exemptions before enrolling in another course, making travel arrangements or submitting a visa application.
Official announcement: Australian Department of Home Affairs — Changes to Student visa application rules.
The new rules introduce changes in two important areas: where applicants can apply and whether family members can be included in Student visa applications.

Rule |
What applicants need to know |
|
Onshore applications |
Most Student visa applicants must apply from outside Australia unless they hold an eligible visa and meet an exemption. |
|
Further Student visas |
Most current Student visa holders can no longer apply for another Student visa while in Australia unless an exemption applies. |
|
Family members |
Most applicants cannot include their partner or dependent children unless they qualify for an exemption. |
|
Subsequent entrants |
Family members can no longer join a Student visa holder later through the subsequent-entrant route under the new rules, subject to the applicable exemptions and transitional arrangements. |
|
Earlier applications |
Applications lodged before 2 October 2026 remain subject to the rules in force on their lodgement date. |
The Department of Home Affairs advises applicants to confirm their eligibility before making study, travel or financial commitments. Applications lodged in Australia by people who are required to apply offshore may be invalid. An ineligible family member included in an application may also have an invalid application.

The scale of Australia’s international education sector helps explain why these rules deserve attention. According to the Australian Government Department of Education’s June 2026 international student data, 687,810 international students studied in Australia during the year-to-date period. This was a 7% decline compared with the same period in 2025.
India accounted for 16% of international students, making it the second-largest source country after China, which accounted for 23%. The government also reported 96,311 new international students in the year to June 2026, down 8% compared with the corresponding period in 2025. These figures describe the wider international student population; they do not measure the number of Indian applicants affected by the new visa rules.

For Indian students, the changes may affect decisions about course progression, visa expiry dates, travel and family relocation. Those already studying in Australia should not assume that their existing visa automatically makes them eligible to apply for another Student visa from within the country. Likewise, students planning to move with a spouse or children should check whether their circumstances fall within an exemption before committing to a study plan.
Yes, in eligible cases. However, most applicants must now apply from outside Australia unless they meet an exemption. The rules apply to new Student visa applicants and current Student visa holders seeking a further Student visa. Applicants should check the eligible visa categories and exemption criteria on the Department of Home Affairs website.
If an applicant must lodge an application offshore, they must also be outside Australia when the visa is granted. The department says an offshore application does not provide a Bridging visa linked to that application. Applicants should not leave Australia or submit a new application based only on general guidance. They should first establish which rules apply to their current visa and personal circumstances.

Most Student visa applicants can no longer include their partner or dependent children unless they meet an exemption. The government defines a student visa family member for these rules as a partner or a dependent child who is unmarried and under 18. Exemptions apply to specified circumstances. In a speech delivered at the National Press Club on 17 September 2026, Home Affairs Minister Tony Burke referred to exceptions involving Pacific and ASEAN countries and certain courses, including PhD programs. Indian applicants should not assume that an exemption available to another nationality or course applies to them. They must check the current official eligibility criteria.
The new rules also restrict family members from joining later through the subsequent-entrant route. Applicants should verify the applicable exemptions and any transitional arrangements before making plans for dependants.

Applications lodged before 2 October 2026 will continue to be assessed under the rules that applied on the date of lodgement. This includes applications that already included eligible family members. However, applicants should distinguish between an application already lodged and a new application they intend to submit. A person who is currently in Australia may face different eligibility requirements when applying for a further Student visa after the changes took effect.
The date of application, current visa status and applicable exemption are therefore important. Applicants with an expiring visa should check their options promptly through the Department of Home Affairs rather than assume that an earlier application or existing enrolment guarantees eligibility for another onshore application.
Indian students planning to study in Australia, continue their studies or relocate with family should take the following steps:
Applicants who are uncertain about their eligibility should seek advice from a registered Australian migration agent or an appropriately qualified legal professional.
