USCIS to Conduct Second Lottery for H-1B applications for FY 2025

U.S. Citizenship and Immigration Services (USCIS) announced the date for second lottery for H-1B applications. The second lottery will soon be held for fiscal year 2025. The USCIS will select few H1B registrations randomly from those applications that were submitted in the first lottery in March 2024. The USCIS has also mentioned that the master’s cap has been reached, so the second lottery will only be for the regular cap.

 

Applications selected in the first lottery will have their USCIS accounts updated to include a selection notice. No details were provided on how many additional registrations will be selected, or exactly when the second lottery will take place.

Why Will USCIS Conduct an H1B Second Lottery?

The primary reason why USCIS is conducting a second lottery for H1B applications for FY 2025 is due to not finding the required number of eligible H-1B applicants in the first round. This situation arises when there are several issues found during the selection of petitions, such as:

 

  • Incomplete Supporting Documents: Some applicants may not submit all the necessary documents, this will lead to rejection of applications.
  • Missing Labour Condition Applications (LCAs): LCAs are very important part of the H-1B petition process. If any applicant fails to submit LCA or improperly filed LCAs will result in application rejections.
  • Inappropriate Wage Descriptions: The wage information provided by the applicant in the petitions must meet specific requirements of H1-B visa. Incorrect or inappropriate descriptions can cause the petitions to be denied.
  • Inaccurate Information about Beneficiaries and Employers: Inconsistency in the information provided about the applicants (beneficiaries) and their prospective employers can also lead to rejection of petition.
