From July 1st the international offices of the U.S. Citizenship and Immigration Services (USCIS) have decided not to accept Form I-407 or the Record of Abandonment of Lawful Permanent Residence (LPR) Status.
After this date, all 1-407 forms must be mailed to a local address in the US. The USCIS has given 60 days to process the form and send it by post.
This new rule will affect foreigners who have status and choose to willingly give it up. They may want to move to some other country and have to notify the USCIS when giving up their LPR status. They should do this by submitting Form 1-407. After the form is accepted and giving up of the LPR status is recorded by the USCIS the applicant need not be concerned about:
Individuals giving up the LPR and looking for re-entry into the US should apply for entry visas.
In case of an application for a new green card, the withdrawing of the LPR status earlier will not be held against the individual.
As for EB-5 investors, after acquiring their Conditional Permanent Resident (CPR) status they should continue to maintain their residency in the country. Otherwise, they may be deported or not admitted into the country. Rules require:
The USCIS intends to shut down all its international offices and shift their responsibilities to their domestic offices. The embassies and offices belonging to the US state department will now take the additional tasks performed by the USCIS earlier.
According to a report in The New York Times, the USCIS plans to shut down its operations in more than 20 countries by the end of the year.
