Children of H1B Visa holders in the US who turn 21 will no longer be eligible for the H4 Visa. Spouse and children of H1B Visa holder are given the H4 Visa. Children of H1Bs who turn 21 will now need to secure F1 Visas (Student Visa) to continue their stay in the US. If not, they may be deported to their home countries.
The children will no longer be able to continue staying in the US on their H4 Visas when they attain 21 years of age. This is disappointing news for many Indian families in the US whose children have reached the age of 21. What adds more to their distress is that there is no surety of getting an F1 Visa.
The US allocates 1.40 lakh Green Card spots every year for employment-based visa applicants. This number is too little considering a large number of Indian families who call the US home. Most of these Indians are on the H1B Visa in the US.
Indian Green Card applicants have to face wait times of up to 10 years for a Green Card, unlike other countries. Citizens of other countries may be able to get their Green Cards within the six years of their H1B Visa but not India.
As of April 2018, there was 6.31 lakh Indians in the Green Card backlog. These include spouses of H1B Visa holders as well as dependent children under 21.
Indians accounted for 76% of all the Green Card backlog in the US.
