FAQs

What are the basic eligibility requirements for a Spain work visa?

To be eligible for a Spain work visa, you must have a valid job offer from a registered Spanish employer and a work authorization (Autorización de Residencia y Trabajo) that your employer obtains on your behalf. You must also hold a valid passport, have relevant qualifications for the job, a clean criminal record, a medical certificate, proof of accommodation and funds, and valid health insurance. The employer must prove that no suitable local or EU/EEA worker is available for the position before the authorization can be granted.

Is a job offer mandatory for a Spain work visa?

Yes, a confirmed job offer is mandatory for the standard Spain work visa. You cannot apply without an employment contract from a Spanish employer. The employer initiates the work authorization process on your behalf, and only after approval can you apply for the visa at the Spanish Consulate in India. Without a job offer, the employer cannot obtain the authorization needed to sponsor your visa.

Who applies for the work authorization in Spain?

The Spanish employer is responsible for applying for the work authorization (Autorización de Residencia y Trabajo por Cuenta Ajena) on behalf of the foreign employee. The employer must submit the application to the relevant Spanish immigration authority and demonstrate that the job cannot be filled by a local or EU/EEA worker. Once approved, the employee can proceed to apply for the visa at the nearest Spanish Consulate.

What documents are required for a Spain work visa from India?

The key documents include a completed visa application form, a valid passport, a recent photograph, the employer-obtained work authorization, a signed employment contract, a Police Clearance Certificate (apostilled and translated), a medical certificate (apostilled and translated), proof of educational qualifications (apostilled and translated), proof of accommodation and financial means, and health insurance. All foreign-issued documents must be apostilled by MEA India and translated by a sworn Spanish translator.

How long does it take to process a Spain work visa?

The standard processing time for a Spain work visa is up to 1 month from the date the application is submitted at the Consulate. This period may be extended if additional documents or a personal interview are required. The employer's work authorization process can take an additional 1 to 3 months before the visa application stage. It is advisable to start the process well in advance of your intended travel date.

Can Indian citizens apply for a Spain work visa?

Yes, Indian nationals are eligible to apply for a Spain work visa provided they meet all the eligibility requirements. This includes securing a job offer from a Spanish employer, obtaining work authorization, submitting all required documents with proper apostilles and certified Spanish translations, and applying at the Spanish Consulate in New Delhi or Mumbai. Indian nationals are considered third-country nationals and must follow the standard non-EU work visa process.

Is there a minimum salary requirement for a Spain work visa?

Yes. The salary offered must comply with Spanish labour law and must not be lower than the Spanish national minimum wage (SMI). As of 2026, the SMI stands at €1,184 per month. The salary must be clearly stated in the employment contract and must be realistic for the job role and industry. Spanish authorities review salary levels during the work authorization process to ensure fair working conditions and prevent exploitation.

What is the validity of a Spain work visa?

The initial Spain work visa (TRA) is valid for 90 days. Once in Spain, you must register with Social Security and apply for the Foreigners Identity Card (TIE) within 1 month. Under the updated Royal Decree 1155/2024 (effective May 2025), the initial residence and work permit is granted for 1 year and can be renewed up to four times, with each renewal lasting up to 4 years. For seasonal work contracts, the visa is valid for the full authorized period.

Do I need health insurance for a Spain work visa?

Yes, valid health insurance is mandatory for a Spain work visa. The insurance must cover the full duration of your stay in Spain and must meet the minimum coverage standards required by Spanish authorities. This ensures that foreign workers have access to healthcare services. Alternatively, upon registration with the Spanish Social Security system, you will be entitled to public healthcare coverage through the employer's social security contributions.

Can I change employers after getting a Spain work visa?

Changing employers after receiving a Spain work visa requires applying for a new work authorization with the new employer before starting employment. The new employer must submit a fresh work authorization application to the immigration authorities. Working for an employer not covered by your existing authorization is illegal and can result in visa cancellation or deportation. Always ensure the correct permit is in place before changing jobs.

Can my family members join me in Spain on a work visa?

Yes. After you obtain your residence and work permit and have legally resided in Spain, you can apply for family reunification for your spouse and dependent children. You must demonstrate sufficient income to support your family, adequate accommodation, and valid health insurance. The minimum income requirement for family reunification increases with each additional family member. Approval depends on meeting all eligibility conditions under Spanish immigration law.

Can I apply for permanent residence in Spain after working there?

Yes. After legally residing and working in Spain for 5 continuous years, you may be eligible to apply for long-term residence (Residencia de Larga Duración). You must show continuous legal residence, stable income, compliance with Spanish law, and valid health coverage during your stay. Long-term residence is a step toward Spanish permanent residency and, eventually, citizenship, which generally requires 10 years of legal residence (with exceptions for nationals of certain countries).

What is the difference between a Spain work visa and a Spain work permit?

A Spain work visa is the entry document issued by the Spanish Consulate in your home country that allows you to travel to Spain. A work permit (Autorización de Trabajo) is the authorization issued by Spanish immigration authorities that allows you to legally work in Spain. For non-EU nationals, both are required. The employer first obtains the work permit on your behalf, and then you apply for the work visa at the Consulate using that permit.

What happens if my Spain work visa application is rejected?

If your application is rejected, the Consulate will provide written notification with the grounds for refusal. You may submit a reconsideration appeal (recurso de reposición) to the same Consulate within 1 month of receiving the refusal notice. You may also file an application for judicial review with the High Court of Justice of Madrid within 2 months. Common reasons for rejection include incomplete documentation, insufficient salary, failure to meet eligibility criteria, or issues with apostilles and translations.
