Highlights: USCIS reached H2-B cap for FY 2024

• March 7, 2024 was the last date for the submission of new H-2B worker petitions.
• H-2B worker petitions received after March 7, 2024 will be rejected.
• USCIS will again begin to accept petitions on March 22, 2024 for employers requesting employment starting date from April 1, 2024, to Sept.
• There will be changes in Fee and Form Editions for H-2B Petitions from Jan. 30, 2024

H-2B Cap for FY 2024

USCIS has received many petitions that is required to meet the legislation mandated H-2B cap for FY 2024. The last date for H-2B workers requesting employment starting on or after April 1, 2024, and before Oct. 1, 2024 was March 7, 2024. USCIS will reject H-2B petitions received after March 7, 2024.

 

USCIS accepts H-2B petitions who are exempt

• H-2B workers who are currently in the United States can extend their stay or change the terms of their employment or change their employers;
• Fish roe technicians and/or supervisors of fish roe processing, and fish roe processors:
• Workers performing services of the Northern Mariana Islands and/or Guam.

 

Filing Dates of Supplemental Visas for FY 2024

The filing start dates for each of the remaining supplemental visas is given below:

 

• For employers looking for workers who are nationals of El Salvador, Haiti, Ecuador, Honduras, Colombia, Guatemala, and Costa Rica, irrespective of whether such citizens are returning workers: USCIS will accept petitions on March 22, 2024, for employers requesting employment starting from April 1, 2024, to Sept. 30, 2024 and for employers requesting employment starting from Oct. 1, 2023, to March 31, 2024, USCIS began accepting petitions in November 2023.
  
   
• For employers looking for returning workers from April 1 to May 14: USCIS will start accepting petitions for additional 19,000 visas to returning workers regardless of country of nationality on March 22, 2024.
   
• For employers looking for returning workers from May 15 to Sept. 30: USCIS will accept additional 5,000 visas to returning workers regardless of country of nationality on April 22, 2024.

 

Note: Petitions submitted after Sept. 16, 2024, or after the cap limit has been reached, whichever occurs first will not be accepted by USCIS.

USCIS announces changes in H-2B Petitions Fee and Form Editions

USCIS announced a final rule on Jan. 30, 2024, there will be changes in the H-2B Petitions Fee and Form Editions. The new fees will be effective from April 1, 2024. H-2B petitions submitted on or after April 1, 2024, must include the new fees.
