How to convert US H-1B Visa to Green Card?

The US H-1B visa is a ''Dual Intent'' visa, implying that this temporary visa is a pathway to permanent residency. Visa holders can apply for a Green Card once they finish their maximum stay period in the country which is six years. Applicants must have a valid sponsorship along with a PERM Labor certification.

Eligibility and Requirements to apply for the US Green Card

The process of converting the US H-1B visa to a Green card is known as the Employment Based Green Card. People who are applying for the US Green Card must belong to one of the following employment based (EB) categories:

 

EB 1 - Priority workers who are highly skilled and are exceptional in fields such as arts, science, athletes, or education fall under this category.

 

EB 2 - Professionals who have advanced degrees (Master's Degrees) or exceptional ability fall under this preference.

 

EB 3 - People who are skilled workers and have a bachelor’s degree along with two years of experience fall under this preference category. The unskilled workers are also given this preference level.

 

EB 4 - This list includes special immigrants who are either religious workers or who have previously worked for the US government or are currently working for the US Armed Forces.

 

EB 5 - The preference is given to the people who are either businessmen who provide at least 10 jobs in the USA and or investors who are investing $500,000 - $1,000,000 in the US economy.

 

Process for converting the US H-1B Visa to Green Card

 

Step 1: Getting a PERM Certificate

The applicant's employer must apply for a Permanent Labor certification from the US Department of Labour.

 

Step 2: Filling Form I-140

The employer must file an application Form I-140 on behalf of the employee; this states the employee's preference level and priority date.

 

Step 3: Submitting For I-485

Once the employer files the Form I-140, the applicants must complete and submit the I-485 Application for the Green Card.

 

Step 4: Receiving the Green Card

Once the application is processed, the applicants will get the Green Card.
