What are the Employee Eligibility Requirements for a UK Work Visa?

To be eligible for the UK Skilled Worker visa, you must fulfil both personal and professional requirements, such as securing a valid job offer meeting the minimum salary threshold, having the required educational qualification and adequate language proficiency (B2 Level).

The eligibility criteria to apply for a UK work visa from India are as follows:

Employer Requirements for Sponsoring a UK Work Visa

Your UK employer also has obligations they must fulfil to sponsor you for a Skilled Worker visa. These requirements are set by the UK Home Office and form part of the sponsor licence framework.

The employer must hold a valid UK Home Office Skilled Worker sponsor licence. Employers without a licence cannot issue a Certificate of Sponsorship.

Certificate of Sponsorship

The employer must assign you a valid Certificate of Sponsorship (CoS) for the specific role you will be performing. Each CoS has a unique reference number used in your visa application.

Salary Compliance

The employer must pay you at least £41,700 per year (or the going rate for your SOC code, whichever is higher) throughout your employment on the visa.

Skills Charge

The employer must pay the Immigration Skills Charge — £1,000 per year for small/charitable sponsors and £1,320 per year for medium/large employers. This is paid by the employer, not the applicant.

Genuine Vacancy

The employer must demonstrate that the vacancy is genuine and meets the RQF Level 6 standard. The Home Office may audit sponsors to verify vacancy authenticity.

Record-Keeping Duty

Sponsors must maintain accurate records of all sponsored workers, including attendance, contact details, and any changes in employment conditions, and report changes to the Home Office.

Compliance Obligations

Sponsors must cooperate with any Home Office compliance visits and notify the Home Office if a sponsored worker stops working for them or fails to maintain their immigration conditions.

 

UK Skilled Worker Visa: Occupations Excluded Under the 2025 Reforms

The UK government's July 2025 immigration reforms significantly narrowed the range of occupations eligible for Skilled Worker sponsorship. Many roles below RQF Level 6 were removed from the route, while some remain temporarily eligible through the Immigration Salary List (ISL) or Temporary Shortage List (TSL). How to Apply for a UK Work Visa from India?

The steps to apply for a UK work visa for Indians are as follows:

Step 1: Find a job with a UK employer who holds a valid Skilled Worker visa sponsor licence.

Step 2: Confirm the role is on the eligible occupations list to meet the RQF Level 6 standard and minimum salary threshold (£41,700 per year).

Step 3: Receive your formal job offer letter with Certificate of Sponsorship (CoS) from your UK employer.

Step 4: Pass an English language test at B2 level (IELTS for UKVI 5.5+ or equivalent.
