Three people are facing charges in California, USA for duping foreign investors in an EB5 Visa scam. The EB5 Visa allows foreign investors to obtain a US Green Card by investing in qualifying businesses in the US.
The three accused are Cooper Lee, Thomas Henderson and Kexing Hu, as confirmed by the US Attorney’s Office. They have been charged with conspiracy charges and wire fraud involving the EB5 Visa program in the US.
Thomas Henderson, aged 70 years, is the owner and founder of the San Francisco Regional Centre. Investigators said that he and the co-accused have duped 200 foreign investors out of $110 million. These foreign investors believed that they had been investing in an EB5 Visa-related business which was sponsored by the regional centre. Investigators did not reveal if these investors had hired attorneys or not, as per Wtop.
Prosecutors said that Henderson diverted the invested amount to other projects by producing fake documents. The scam prevented the creation of more than 2,000 jobs in the San Francisco Bay Area.
Tatum King, Special Agent, Homeland Security, said that such immigration scams not only rob innocent investors but also deter other genuine ones. Not only that, but such scams also pose a serious threat to public safety and national security.
Henderson has already been arrested in Oakland and had also been presented in court. He has to return to court for a status conference on 1st October. The other accused Cooper Lee, 42, has been arrested in Laguna Beach, California. Kexing Hu is absconding and yet to be found.
