Overview

The EB5 visa allows foreign nationals to become permanent residents of the USA. It is an excellent opportunity for those interested to settle in the USA.

Regular Program

A person investing $500,000 in certain circumstances or $1 million in a business that creates 10 jobs may be granted EB-5 permanent resident status.
The basic government criteria for this status are:

1. Investment must be in a business, not a passive investment such as the stock market;
2. Invested funds must be the individual's, but may be a gift from a parent or other person,
3. The business must have been created after November 29, 1990 or the investment must substantially change an older business.;
4. The amount of investment may be $500,000 in a rural or high unemployment area.
5. Create 10 jobs – no direct job creation is required if the investment is in a Regional Center Program

Regional Center Program

3,000 visas have been set aside each year for people to invest at least $500,000 in designated Regional Centers.

You are not required to create 10 direct jobs in the USA but need to show your investment will indirectly create the same.

Regional Centers are designated as "any economic unit, public or private, which is involved with the promotion of economic growth, including increased export sales, improved regional productively, job creation, or increased domestic capital investment."

The investment requirement is only $500,000 if a Regional Center is in a targeted employment area, which is either in a rural or high unemployment area, as defined hereinafter in the section on EB-5 Regulations.

EB-5 petitions filed through a Regional Center are given priority and are processed immediately.

Once Permanent Resident status is granted, minimal involvement with the investment is permitted, allowing the applicant to work in any business, go to school, or enjoy retirement.

Procedures

You will need to make your investment, show that you have created 10 direct jobs (for the regular program), file the petition at a CIS Service Center & then apply for your visa at a US Consulate.

You will first receive a conditional resident status and can remove it after 21 months. Upon approval from the CIS, a PR status is granted.

Process

1. Send us an expression of interest by filling in the Inquiry Form below. Our Consultant will contact you within 24 hours.

 

2. Our Consultant will explain the details of this visa and discuss with your profile & suitability for it.

 

3. If you are suitable, you will be required to make a retainer payment to Y-Axis

 

4. After receipt of your payment, your processing begins where your Process Consultant will take over and begin working on your case. Areas covered: commitment of funds and required documentation to prove the investment and tracing of the funds.

 

5. Payment of Y-Axis Professional fee Installment 1

 

6. Investment: We will assist you with finding an agent who will narrow down investment opportunities for you and investigate whether the investment is financially viable. All fees payable to the agent is in addition to the Y-Axis fee.

 

7. One you have closed on the opportunity, you will make the capital investment.

 

8. Payment of Y-Axis Professional fee Installment 2

 

9. Y-Axis will then File Petition for Alien Entrepreneur with the CIS.  This petition requests CIS to certify the applicant and the investment as eligible for EB-5 status. Additional fees payable to the CIS are applicable from your end.

 

10. Once your petition is approved, you may apply for your visa which allows you to live, work or study in the USA. You may choose to be involved in your investment on an active basis or to be a sleeping partner.

 

11.  You will be granted conditional resident status and will wait for 21 months to reconfirm that the full investment has been made and 10 jobs created (if required, based on type of investment)

 

12. Payment of Y-Axis Professional fee Installment 3

 

13. Y-Axis will then file the application to remove conditional resident status (Form I-829) between 21 to 24 months after Conditional Resident status is approved.

 

14. Once conditional resident status is removed, a full Green Card is granted for indefinite permanent resident status and work permission in the United States. U.S. Citizenship is possible 5 years later, upon satisfaction of residence and other criteria.

Fees specified above are only Y-Axis Service & Professional fees. All other payments to be made to CIS, US Consultate or other external agencies are in addition to the above fees.

Refund Policy: The fees payable to Y-Axis are 100% non refundable
