Overview


The Last Remaining Relative visa category is for people who intend to migrate to Australia and live with their near relatives. To be eligible to apply, the applicant should demonstrate that a brother, sister or parent (including step-equivalent) is an Australian citizen, permanent resident or eligible New Zealand citizens and is resident in Australia.  

The applicant should also prove that there are no other brothers, sisters, children or parents (including step equivalents) other than those in Australia. The spouse also should not have any close relative other than a relative who is usually resident in Australia. The eligible relative (or eligible's spouse) must be able to sponsor the applicant.


Eligible Relative

An eligible relative is someone who is:

  • A parent, brother or sister, or
  • A minor child who is not in the applicant’s care, or
  • An adult child over 18 who is not dependent on the applicant, or
  • Step equivalents of the above; and
  • If the applicant is under 18, and were adopted overseas by an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

 The sponsor will not be eligible to sponsor if he/she:

  • Has previously sponsored/nominated a person who has subsequently been granted a visa on the basis of being a remaining relative; or
  • Was granted a visa on the basis of being a remaining relative

The visa can be applied for from inside or outside Australia. If you are applying while you are inside Australia you must also hold a valid substantive visa and be in Australia at the time the visa is granted. If you apply for this visa while you are outside Australia you must also be outside of Australia at the time the visa is granted.

Health and character requirements have to be met by the main applicant and any dependents included in the application.

The last remaining relative application can include the main applicant and, if applicable, spouse and dependants. A dependent child could be a natural child, adopted child or a step-child. Children over the age of 18 years will not be considered dependant unless the applicant can show that they are wholly or substantially reliant on them for financial support.

  • As permanent residents the applicant and their dependents will have access to government-subsidized healthcare and social security, after a wait period of 2 years.
