Overview

This is a provisional visa which is granted for a period of three years for individuals who cannot meet the Skilled Independent visa pass mark. This visa provides a pathway to permanent visa in Australia.

The basic requirements of this visa is to get sponsorship either from a sponsoring State/ Territory or eligible relative living in designated area. Applicants should also meet the points test by scoring 100. This visa is designed by the Australian government to address skill shortages in designated areas of Australia.

The Skilled Regional Sponsored visa is a provisional visa only and applicants under this category must live for two years and work for at least twelve months in a Specified Regional Area of Australia.

Basic Features

• Applicants are allowed to live, work and study in a designated area of Australia for period of 3 years.
• Provides a pathway to permanent visa in Australia.
• Applicants are allowed to apply for permanent visa after the applicant has lived for two (2) years in a designated area of Australia.
• The applicant can score 10 points if sponsored by State/ Territory government and 25 points if sponsored by an eligible relative living in designated area.
• Applicants can take their immediate family members provided they meet with requirements of health, character and English language.
• Allows the dependents to study and work in designated areas of Australia.

Eligibility

Applicant Eligibility

The applicants have to satisfy the basic requirement to migrate under the skilled regional visa and must meet 100 points to file for a visa.

• Age: The age of the applicant should be between 18 -45 years.
• English language: The applicant should demonstrate that he/she meets the English language of competent or vocational level by submitting the test results before the application is lodged
  You also meet the English Language Threshold (IELTS 6 bands in all the components-15 points) if you hold a valid passport from, and are a citizen of, one of the following countries United Kingdom (UK) ,Canada ,New Zealand ,United States of America (USA) ,Republic of Ireland .If you need 25 points under Proficient English(IELTS 7 or above bands in all the components), English Language test results are required.
• Nominated occupation The applicant should nominate an occupation on the Skilled Occupation List (SOL) that is relevant to his /her skills and qualifications and recent work experience.
• Skill Assessment - It is mandatory for an applicant to get a positive skill assessment for a nominated occupation before the application is lodged. The applicant should hold a post secondary qualification which is at least equivalent to an Australian Bachelors degree (or higher), diploma or trade qualification [Australian Qualification Framework (AQF) certificate III or IV].
• Recent work experience or Recent two years study from AustraliaAustralia - The applicant should be able to demonstrate that he/she has been recently employed (for 12 months out of 24 months immediately before lodging the application) in an occupation listed on SOL or meet with Australian study requirement relevant to the nominated occupation in the last 6 months before lodging the visa application.
  
  Additional Points – Points can also be earned on the following eligibility criteria
• Partner SkillsSkills –The applicant can claim points under partner skills, if the partner satisfies the basic requirements of age, English language ability, qualifications, nominated occupation and recent work experience or two years study in Australia. The partner should obtain positive skills assessment from a relevant assessing authority.
• Australian Study –The applicant can claim additional points for Australian study for a qualification which is a course of at least two Academic years or more.
  Live and Study in Regional Area: The applicant can claim additional points, if the Australian study requirement of living and studying in a 'regional low population growth metropolitan area' in Australia, is met.
• Australian Experience – The applicant can claim points for having worked in Australia in one of the occupations listed on the SOL, in a full-time paid employment and for at least one year in the last four years.
• Specific Experience points - The applicant can claim additional points for having at least 3 years of overseas experience in the nominated occupation in the last 4 years.

Health and Character Requirements

The applicant and the dependents are also required to meet with the health and character requirements.

• Health Requirement -The medical examination should be conducted by a panel of doctors approved by the Australian government.
• Character Requirements Requirements – The Applicant should obtain police certificates from all countries in which he/she lived for more than 12 months cumulative or over a continuous period in the last 10 years leading up to the application

Sponsor eligibility

The applicant is either sponsored by a State/Territory or a relative. To be sponsored by the State or Territory, the applicant should nominate an occupation from the State or Territory’s skilled occupation list.

Sponsorship by a Relative

• The applicant should be sponsored by an eligible sponsor who is either an Australian citizen or an Australian permanent resident, or eligible New Zealand citizen residing in Australia.
• Relation:The relation between the sponsor and the applicant can be either brother or Sister, Parent, Non-dependent child, Uncle or Aunt, Nephew, Niece, relative of the applicant’s spouse, de-facto spouse interdependent partner or Half- and step-relatives.
• Location -The sponsor should be living in a designated area* of Australia before lodging the application and also should demonstrate that he /she will continue to live in the designated area till the decision regarding the application is made.
• Assistance –The sponsor will have to sign a sponsorship undertaking stating that he/she will provide required assistance to meet the applicant’s financial and social obligations for the period of two years to make the applicant’s living comfortable in Australia.

Exception: This is not payable if you hold a provisional visa, and paid the 2nd instalment for your first provisional skilled visa, and are applying for a 12 month renewal.

   The basic requirements of the applicant for skill regional sponsored visa are

2. Can I get sponsorship from one participating State/Territory and live in a highly populated area of the same country?
   No, it is mandatory for you to live or work or study in designated areas of sponsoring State /Territory of Australia.
3. What is the skilled occupation list (SOL)?
   Skilled occupation list (SOL) provides the list of opportunities available in Australia for people who are on skilled migration to Australia. The applicant has to nominate an occupation that matches with the skills, work experience and qualifications.
4. What is Australian Study requirement?
   The applicant must have completed 16 calendar months during his/her course of study , either for a single qualification requiring at least two (2) academic years study or for more than one qualification resulting in a total period of at least two (2) academic years study.
5. What is recent work experience?
   To meet with recent work experience criteria of Australia SIR visa you should be employed in an occupation listed on SOL. The employment should be at least for 20 hours a week in a paid position. The employment should be at least for period of 1 year out of 24 months immediately before lodging your visa application.
6. How do I qualify for PR visa holding Skilled Regionally Sponsored Visa?
   You will be eligible to apply for permanent visa after you have lived for two (2) years and worked for at least 12 months in a specific designated area Australia.
7. Can I stay in Australia whilst lodging the application?
   Yes, you can stay in Australia whilst lodging the application unless there is condition on your current visa that prevents you from staying in Australia
8. What should I do if my dependent does not have functional English?
   Dependents aged18 years and over have to pay second installment visa application charge if he/she does not have functional English.
9. Can I take my dependents along with me?
   Yes, you are allowed to take your dependents to Australia along with you, provided they satisfy the requirements of English language, health and character.
10. What If I am not able to meet the requirements to be granted a permanent visa after three years?
    You will be granted a second SIR visa provided you have compiled with the conditions of SIR visa. The second SIR visa will be valid for a period of 12 months
